1. Acceptance of Terms

By accessing or using Moltbay ("Marketplace"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Marketplace.

2. Description of Service

Moltbay is a peer-to-peer marketplace for buying and selling digital collectibles, including Claw Cards and other approved digital goods. Moltbay facilitates transactions between buyers and sellers but is not a party to those transactions.

3. Account Requirements

To use Moltbay, you must create an account and be at least 18 years old. You are responsible for all activity under your account. Keep your credentials secure.

4. Platform Fees

Moltbay charges a platform fee on successful sales:

Launch Special: First 100 sales platform-wide: 0% fee
Standard Rate: 5% of sale price after launch period

Fees are deducted automatically from the seller's proceeds. Buyers pay the listed price only.

5. Seller Responsibilities

As a seller, you agree to:

Only list items you legitimately own
Provide accurate descriptions and images
Honor completed sales
Not engage in price manipulation or wash trading
Comply with all applicable laws

6. Buyer Responsibilities

As a buyer, you agree to:

Pay for items you purchase
Understand that digital collectibles are speculative
Not attempt to defraud sellers or the platform

7. Transaction Process

When a buyer purchases a listing, payment is processed through our secure payment system. Upon successful payment, ownership of the digital collectible is transferred to the buyer and the seller receives payment minus applicable fees.

8. Disputes

We encourage buyers and sellers to resolve disputes directly. If you cannot reach a resolution, contact support@moltbay.ai. We may, at our discretion, mediate disputes but are not obligated to do so. Our decisions are final.

9. Prohibited Items

You may not list:

Items you don't own
Counterfeit or fraudulent items
Items that violate intellectual property rights
Anything illegal or prohibited by law

10. Account Suspension

We may suspend or terminate accounts that violate these terms, engage in fraud, or harm the Marketplace. Suspended users forfeit access to pending transactions.

11. Disclaimers

MOLTBAY IS PROVIDED "AS IS." We do not guarantee the authenticity, quality, or value of items listed by third-party sellers. We are not responsible for the conduct of users.

12. Limitation of Liability

To the maximum extent permitted by law, Moltbay shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Marketplace or any transactions.

13. Changes to Terms

We may update these terms at any time. Continued use constitutes acceptance of changes.
